General Terms and Conditions (AGB) of LOQAL GmbH
§1 Scope of Application
(1) These General Terms and Conditions (AGB) apply to all orders placed through the online shop of LOQAL GmbH.
(2) The provider and contractual partner is:

(3) Deviating conditions of the customer will not be recognized unless their validity is expressly agreed to in writing.
§2 Subject Matter of the Contract
(1) LOQAL offers individually designed print-on-demand products, particularly clothing and accessories.
(2) The products are only produced individually for the customer after ordering. There is no stock holding.
(3) The design of the products is done dynamically based on user inputs (e.g., location data, designs, customizations).
§3 Conclusion of Contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order.
(2) By completing the ordering process, the customer makes a binding offer.
(3) The contract is concluded as soon as the order is confirmed by email or production is initiated.
§4 Prices and Payment
(1) All prices in euros are final prices and include the statutory value-added tax. Shipping costs displayed during the ordering process will be added.
(2) For deliveries to countries outside the European Union, customs duties, import sales tax, or other charges may apply, which are to be borne by the customer, unless they are indicated and collected during the ordering process. For prices in US dollars, any applicable sales tax is not included and will be separately indicated during the ordering process.
(3) The payment methods displayed during the ordering process are available, particularly credit and debit card, PayPal, Apple Pay, Google Pay, Shop Pay, and for orders from Europe, Klarna.
(4) Payment is due immediately upon conclusion of the contract.
§5 Delivery and Shipping
(1) We deliver to Germany and to the countries offered during the ordering process. Details can be found on our Shipping & Delivery page.
(2) Since the products are made individually, the delivery time is usually 5–10 working days within Germany, 5–12 working days to other EU countries and the USA, and 7–20 working days to other countries.
(3) Delivery is carried out by an external shipping service provider.
§6 Retention of Title
The goods remain the property of LOQAL GmbH until full payment is made.
§7 Right of Withdrawal
(1) Consumers generally have a statutory right of withdrawal.
(2) The right of withdrawal is excluded for contracts concerning goods that are not pre-manufactured and for which the customer's individual selection or specification is decisive for their production (§ 312g Abs. 2 Nr. 1 BGB).
(3) This applies in particular to all products that are individually created based on user inputs (e.g., location data, designs, or personalizations).
§8 Warranty
(1) The statutory warranty rights apply.
(2) In case of defects, the customer is entitled to subsequent performance (reproduction or replacement delivery).
(3) Individual design decisions made by the customer do not constitute a defect.
§9 Liability
(1) The liability of LOQAL GmbH is governed by the statutory provisions.
(2) In cases of slight negligence, LOQAL is only liable for the breach of essential contractual obligations and limited to the foreseeable damage.
(3) Liability for damages resulting from injury to life, body, or health remains unaffected.
§10 Copyrights and Content
(1) To the extent that the customer influences the design of a product, they are responsible for ensuring that no third-party rights are violated.
(2) The customer indemnifies LOQAL GmbH from all claims by third parties arising from such legal violations.
§11 Technical Deviations
Deviations in color, material, or printing may occur for production technical reasons and do not constitute a defect, provided they are reasonable.
§12 Data Protection
Personal data is processed exclusively within the framework of the statutory provisions and used for the processing of the order.
§13 Dispute Resolution
LOQAL GmbH is not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
§14 Jurisdiction and Applicable Law
(1) The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) The place of jurisdiction is Bremen, provided the customer is a merchant.
